Does my final paycheck have to go on a paycard in the state of California?
I have been employed by Lane Bryant, Charming Shoppes Inc. for the past year. I put in my two weeks about 2 and a half weeks ago and my store manager called me and told me I had to come in and pick up my paycard and sign some papers. I have been receiving my paycheck via direct deposit for the past year. I know from other girls that work there that the store manager doesn’t like to do things “by the book” so I just want to make sure.
Your final paycheck does not have to be by paycard–it can be direct deposited. There is no law specifying it must be one way or the other, and is left entirely to company policy. However, by California law you must receive your final pay within 48 hours of the end of your last shift, unless you agree in writing that it can be longer. That final paycheck should include not only payment for all hours worked & owed, but also any cash-out value of unused vacation time. Because of these extras, and because many times that 48 hour window doesn’t fall on a normal payday, a lot of companies prefer to issue an actual check. It also provides an incentive for the employee to come in and sign any paperwork the company wants/needs signed.
